If from July 1, 2018 to November 30, 2023 more than one text message from Clover Network selling its or its customers’ products and services was sent to your cellphone while you were on the National Do Not Call Registry and you did not have a prior established business relationship with Clover or its customer, you could get a payment from a class action settlement.
Defendant Clover Network, LLC (“Clover”) has agreed to pay up to $15,000,000 into a settlement fund from which eligible persons (“Settlement Class Members”) who file a valid Claim Form will receive a $60 cash award.
Clover sells and operates point-of-sale (“POS”) systems for businesses that, among other things, allow those businesses to take payments from their customers. Clover’s POS systems also allow those businesses to engage with their customers via text message by sending digital receipts, marketing promotions, and reward points information.
The settlement resolves a lawsuit involving allegations that class members received text messages sent by or on behalf of Clover or one of Clover’s business customers who were on the National Do Not Call Registry and did not have a prior established business relationship with Clover or Clover’s business customers in violation of the Telephone Consumer Protection Act (“TCPA”). Clover denies all allegations of wrongdoing in the lawsuit. As part of the proposed settlement, Clover does not admit to any wrongdoing and continues to deny the allegations against it. The Court has not decided who is correct.
